mesothelioma

Not a general lung cancer, and not a disease only smokers get. Mesothelioma is a rare, aggressive cancer that forms in the mesothelium, the thin lining around organs such as the lungs, abdomen, heart, or testes. Most cases are linked to asbestos exposure, often years or even decades earlier. The most common type is pleural mesothelioma, which affects the lining around the lungs and can cause chest pain, shortness of breath, coughing, and fluid buildup.

What makes mesothelioma so significant in a legal claim is the long delay between exposure and diagnosis. A person may have been exposed on a jobsite, in an old building, or by handling contaminated clothing long before any symptoms appeared. That delay often turns a case into a toxic tort, product liability, or wrongful death claim focused on who knew about the danger, when they knew it, and whether they failed to warn or protect workers and families.

In New York, timing can be different from an ordinary injury case because latent exposure claims may fall under CPLR 214-c (1986), which generally gives a person three years from discovering the injury, rather than from the original exposure. There can also be a limited extra period tied to discovery of the cause under CPLR 214-c(4). Medical records, pathology results, work history, and expert proof are often central to establishing liability and damages.
